KNF PROPERTIES – PROPERTY LISTING, VERIFICATION & PROTECTION PLATFORM (CAMEROON ONLY)

1. DEFINITIONS AND INTERPRETATION

1.1 Definitions

In these Terms and Conditions (“Terms”), unless the context otherwise requires:

• “Platform” means the website https://knfproperties.com and all related digital systems operated by KnF Properties SARL within the territory of the Republic of Cameroon.
• “KnF Properties SARL”, “KnF Properties”,“Company”, “we”, “us”, “our” means the legal owner and operator of the Platform, registered and operating under the laws of the Republic of Cameroon.
• “User” means any natural person or legal entity accessing or using the Platform within Cameroon.
• “Property” means land or immovable property situated exclusively within the national territory of the Republic of Cameroon, including buildings and permanent fixtures.
• “Protection Mode” means a none-commercial registration service intended to deter unauthorized transactions.
• “Verification Engine” means the multi-tier verification framework developed by KnF Properties.
• “Verification Level” means any verification stage from Level 0 to Level 4.
• “Content” means all information, documents, images, videos, GPS data, communications, and records submitted or generated on the Platform.

1.2 Interpretation

These Terms shall be interpreted in accordance with Cameroonian law, including:

• Ordinance No. 74-1 of 6 July 1974 to establish rules governing land tenure
• Ordinance No. 74-2 of 6 July 1974 to establish rules governing state lands
• Decree No. 76-165 of 27 April 1976
• The OHADA Uniform Acts, where applicable

2. TERRITORIAL LIMITATION OF SERVICE

2.1 Cameroon-Only Scope

The Platform provides services solely for properties located within the Republic of Cameroon.

Any attempt to list, register, verify, or protect property located outside Cameroon is null and void and constitutes a breach of these Terms.

2.2 Applicable Legal Framework

All services provided by KnF Properties are governed exclusively by:

• The laws and regulations of the Republic of Cameroon
• Applicable OHADA Uniform Acts

No foreign law shall apply.

3. ACCEPTANCE OF TERMS

By accessing or using the Platform, the User expressly acknowledges that:

• They are operating within Cameroon
• They submit to Cameroonian law
• They accept the exclusive jurisdiction of Cameroonian courts

If the User does not agree, access must cease immediately.

4. USER ELIGIBILITY AND LEGAL REPRESENTATIONS

The User represents and warrants that:

1. They are at least eighteen (18) years old.
2. They possess legal capacity under Cameroonian law.
3. Any claim of ownership, customary right, lease, or allocation complies with Cameroonian land tenure laws.
4. All submitted documents are authentic and lawfully obtained.
5. They acknowledge that only a duly registered Land Title (Titre Foncier) constitutes conclusive proof of ownership under Cameroonian law.

The User bears full civil and criminal liability for false declarations.

5. NATURE OF THE PLATFORM AND LEGAL LIMITATIONS

5.1 No Substitution of Public Authorities

KnF Properties:

• Is not a Land Registry (Conservation Foncière)
• Is not a Divisional Officer, Survey Service, or State Authority
• Does not issue land titles or legal certifications

5.2 No Transfer or Guarantee of Ownership

The Platform:

• Does not effect land registration
• Does not transfer ownership
• Does not cure defects in title

• Does not override administrative or judicial decisions

   

6. PROPERTY LISTING REQUIREMENTS

All listed or registered properties must include:

1. Property type
2. Administrative location (Region, Division, Subdivision, Quarter)
3. GPS coordinates (mandatory for land)
4. Legal classification:
   • Registered Land (Land Title)
   • Customary Land (unregistered)
   • Lease / Allocation
5. Supporting documentation

Submission of false or manipulated documents constitutes fraud under Cameroonian criminal law and may be reported to competent authorities.

7. PROPERTY PROTECTION REGISTRATION (PROTECTION MODE)

7.1 Legal Nature

Protection Mode is a private, digital notice mechanism designed to reduce fraudulent transactions.

7.2 No Legal Effect on Title

Protection Mode:

• Does not constitute land registration
• Does not create real rights
• Does not replace administrative or judicial procedures

It may serve only as supporting evidence, subject to judicial appreciation.

8. VERIFICATION ENGINE AND LEGAL STATUS OF VERIFICATION

8.1 General Principle

Verification reflects procedural checks, not legal certainty.

8.2 Verification Levels

Level 0 – Unverified

Ownership claim only; no verification.

Level 1 – Automated Consistency Checks

Detection of duplicate data, documents, or GPS coordinates.

Level 2 – Community and Witness Verification

Witness confirmations recorded for customary context only.

Level 3 – Physical Field Verification

On-site inspection and geo-tagged evidence by agents or partners.

Level 4 – Government Verification (Premium)

Administrative confirmation attempts at:

• Conservation Foncière
• Divisional Officer’s Office
• Survey Services

8.3 Legal Disclaimer

No Verification Level:

• Confers ownership
• Replaces a Land Title

• Constitutes a government act

   

9. USER CONDUCT AND PROHIBITED ACTIVITIES

Users shall not:

• Sell or attempt to sell land without authority
• Upload forged documents
• Impersonate landowners or officials
• Engage in multiple sales of the same property

Violations may lead to:

• Immediate termination
• Civil liability

• Criminal referral under Cameroonian law

   

10. FEES AND PAYMENTS

Certain services may be subject to fees.
All fees are:

• Disclosed in advance
• Payable in accordance with Cameroonian commercial law
• Non-refundable once service execution begins

11. DATA PROCESSING AND CONSENT

Users consent to:

• Storage of data within systems operated for Cameroon
• Contacting witnesses and verification agents
• Recording verification evidence

Data handling complies with applicable Cameroonian data protection principles.

12. INTELLECTUAL PROPERTY

All Platform systems, verification architecture, branding, and software are the exclusive property of KnF Properties under Cameroonian intellectual property law.

13. DISCLAIMER AND LIMITATION OF LIABILITY

To the maximum extent permitted by Cameroonian law, KnF Properties shall not be liable for:

• Land disputes
• Invalid titles
• Administrative errors
• Fraud by Users or third parties
• Financial losses arising from reliance on Platform data

14. INDEMNIFICATION

The User agrees to indemnify KnF Properties against all claims, losses, damages, or proceedings arising from:

• False declarations
• Fraudulent listings

• Breach of these Terms

   

15. TERMINATION

KnF Properties may suspend or terminate access at its discretion where:

• Legal risk arises
• Fraud is suspected

• Authorities require cooperation

   

16. GOVERNING LAW AND JURISDICTION

These Terms are governed exclusively by the laws of the Republic of Cameroon.

All disputes shall fall under the exclusive jurisdiction of Cameroonian courts.
